Privacy Policy

At Compass Group Canada Ltd. (hereinafter referred to as “us”, “we” and/or “Compass”), we respect your privacy. Our privacy policy (“Privacy Policy”) summarizes what personal information we collect when you use the Home is Here Application (the “Application”), and how we use and disclose this information. This Privacy Policy also describes other important topics relating to your privacy.

By downloading, installing or using the Application, you signify your consent to all of the terms of this Privacy Policy, and that of your parent or legal guardian if you are under the age of majority in your jurisdiction or residence. If you do not agree with any terms of this Privacy Policy, please do not download, install, or use the Application.

Compass reserves the right to modify this Privacy Policy at any time. We will reflect any such modifications to this Privacy Policy in our Application and will indicate on this page the date this Privacy Policy was last amended. Your continued access to and/or use of the Application after any such changes constitutes your acceptance of, (and that of your parent or legal guardian if you are under the age of majority in your jurisdiction or residence), and agreement to be legally bound by, this Privacy Policy, as revised. Please periodically review this Privacy Policy so that you know what personal information we collect, how we use it, and with whom we may share it.

1. What Personal Information Does the App Collect?

Personal information is information about an identifiable individual, such as your name, address, telephone number, email address, or payment information (“Personal Information”). We collect Personal Information when you voluntarily provide it through our Application, or when you provide it to us through other means. For example, we may collect Personal Information when you:

  • Provide us with information on downloading the Application;
  • Create an account;
  • Use the Application to make a purchase; or
  • Otherwise provide us with Personal Information.

The information we may collect may include:

  • When you create an account, your first and last name; contact information, such as your address, telephone number, or e-mail address; and your selected location for your account;
  • If you choose to make a purchase, your payment information;
  • the general location of your mobile device (based on your IP Address) to help recommend food service locations near you;
  • Any other Personal Information that you voluntarily choose to submit to us or to the Application, and
  • Usage information regarding your use and experience of the app (See How Compass Collects Information Through Technological Means for more information).

2. How Compass Uses and Discloses Personal Information

The Personal Information we collect may be used or disclosed by Compass for the purposes for which it was collected, as provided in this Privacy Policy, or for other purposes that are disclosed to you and to which you consent. For example, we may use or disclose your Personal Information to:

  • Operate the Application in accordance with its Terms of Use,
  • Facilitate a purchase you choose to make using the Application, including facilitating payment for your purchase;
  • Notify you when an order you have made using the Application is ready for pick-up, and identify you when you make a pick-up;
  • Respond to your questions or inquiries;
  • To conduct market research and surveys;
  • To conduct promotional activities, including contests, in association with the Application;
  • To improve our products, services and Application;
  • Supply you with requested information;
  • To send you informational or promotional communications that you have agreed to receive;
  • To carry out other purposes that are disclosed to you and to which you consent;
  • To carry out any other purpose permitted or required by law.

We reserve the right to transfer any Personal Information we have about you in the event that we merge with or are acquired by a third party or should any such transaction be proposed.

We may also use, or disclose your Personal Information to third parties if we have reason to believe that using or disclosing such information is necessary to: (i) conduct investigations of possible breaches of law; (ii) identify, contact, or bring legal action against someone who may be violating an agreement they have with us; (iii) investigate security breaches or cooperate with government authorities pursuant to a legal matter, for example, if we are subject to a subpoena, court order, or the information is requested by the police or another law enforcement entity; or (iv) to protect our rights, safety or property.

We may transfer your Personal Information to third party service providers that assist us with carrying out these purposes. For example, we may use third party service providers to facilitate payments.

3. Social Widgets and Third Party Application

The Application may contain third party plug-ins and/or applications, and/or links to third-party websites that are not owned, controlled or operated by Compass, including without limitation, and social media plug-ins, (collectively, “Third-Party Applications”), including websites operated by advertisers, licensors, licensees, and certain other third parties. These plug-ins and/or applications may include functionality that allows you to create or login to an account using information that is accessed from one of your social media profiles. Compass may have no control over the content, operations, policies, terms, or other elements of Third-Party Applications, and Compass does not assume any obligation to review any Third-Party Applications. Compass does not necessarily endorse, approve, or sponsor any Third-Party Applications, or any third-party content, advertising, information, materials, products, services, or other items. Furthermore, Compass is not responsible for the quality or delivery of the products or services offered, accessed, obtained by or advertised at such Third-Party Applications. Finally, Compass will under no circumstances be liable for any direct, indirect, incidental or special loss or other damage, whether arising from negligence, breach of contract, defamation, infringement of copyright or other intellectual property rights, caused by the exhibition, distribution or exploitation of any information or content contained within these Third-Party Applications. Any activities you engage in connection with any of the same are subject to the privacy and other policies, terms and conditions of use and/or sale, and rules issued by the operator of the Third-Party Applications. Compass disclaims all liability in connection therewith. Any interactions, correspondence, transactions, and other dealings that you have with any third parties found on or through the Application (including on or via Third-Party Applications or advertisements) are solely between you and the third party (including issues related to the content of third-party advertisements, payments, delivery of goods, warranties (including product warranties), privacy and data security, and the like). Compass disclaims all liability in connection therewith.

4. How Compass Collects Information Through Technological Means

When you use our Application, we may collect information about your use of the Application. This information may include information that tracks your session within the Application, including any in-application crashes or usage blocks. We may also collect other general information (such as the type of browser you use, which pages you view, and the files you request). We use this information to better understand how visitors use our Application, and to improve our Application and user experience.

5. How we Protect Personal Information

The security of your Personal Information is important to us. We protect your Personal Information by maintaining physical, organizational and technological safeguards intended to help protect against unauthorized use, disclosure or access. Personal Information may be accessed by persons within our organization, or our third party service providers, who require such access to carry out the purposes indicated above or other purposes permitted or required by applicable law.

Although we have taken measures to help protect our Application, computer systems and any Personal Information that we have collected from unauthorized use, access, disclosure, misuse, alteration or destruction, no security measures can provide absolute protection. We cannot ensure or warrant the security of any information you provide to us.

6. Your Choices

If you have provided us with your Personal Information, but later decide you no longer want us to send you any information about us, simply contact us here. If you receive commercial email from us, you can also opt-out by using the “unsubscribe” tool in our commercial email.

7. Personal Information may be Transferred Outside of Canada

Some or all of the Personal Information we collect may be stored or processed outside your jurisdiction of residence, including in the United States, whose data protection laws may differ from the jurisdiction in which you live. As a result, this information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions. By providing us with Personal Information, you understand and expressly agree that we may transfer it outside of Canada or your jurisdiction of residence. If you do not agree to the transfer of your Personal Information outside of Canada or your jurisdiction of residence, do not provide us with Personal Information.

8. Access and Rectification

You have a right to request access to your Personal Information and to request a correction to it if you believe it is inaccurate. If you have submitted Personal Information to Compass and would like to have access to it, or if you would like to have it removed or corrected, please contact us using the contact information provided below. We will use reasonable efforts to comply with your request; however, in some cases we may not be able to allow you to access certain Personal Information in certain circumstances, for example if it contains Personal Information of other persons, or for legal reasons. In such cases, we will provide you with a reasonable explanation of why it is not possible to grant access to your Personal Information.

To help protect against fraudulent requests for access to your Personal Information, we may ask you for information to allow us to confirm that the person making the request is you or is authorized to access your Personal Information before granting access. For example, we may require you to verify your identity before you access your Personal Information.

9. Children and Parents

Compass does not knowingly collect Personal Information from children under the age of thirteen (13). If a child has already provided us with Personal Information, his or her parent or guardian may contact us for the purpose of deleting this information.

10. Third Party Websites

The Application may contain links to other third party websites. These other websites may have their own privacy policies and terms and conditions that are not governed by this Privacy Policy. We are not responsible for the privacy practices or the content of any website(s) owned and operated by any such third parties. Other websites may collect and treat information collected differently, so we encourage you to carefully read and review the privacy policy for each website you visit. Any links from this Application to other websites, or references to products, services or publications other than those of Compass, do not imply the endorsement or approval of such websites, products, services or publications by Compass.

11. How to Contact Us

If you have any questions regarding this Privacy Policy, any Personal Information you have submitted to us, or if you would like to:

  • access Personal Information that you have already provided to us so that you can correct or update it, or request that it be deleted;
  • request the deletion of Personal Information regarding your minor child; or
  • report any violation of this Privacy Policy;
